The School Exemption from the Enhanced Tier

Early years, primary, secondary, and further education settings have a special consideration — they remain in the Standard Tier, even if more than 800 people are present. Enhanced duties do not apply to these settings.

Higher education is different: HE premises can be Standard (200–799) or Enhanced (800+).

Ofsted and Safeguarding Alignment

Inspectors may look for evidence that schools have appropriate procedures in place and can demonstrate compliance with the Act. This could include reviewing documentation, training records, and emergency plans, and understanding how these are integrated into everyday safeguarding and governance.

In practice, being able to evidence compliance with Martyn’s Law is likely to signal strong leadership and effective school management.
